These terms govern your use of upperboundrx.com and app.upperboundrx.com (together, "Upperbound," "we," "us"). By creating an account or purchasing a pathway, you agree to them.
Upperbound is a platform that connects you with independent, licensed physicians for telehealth consultations and, where a physician determines it is appropriate, treatment fulfilled by a licensed pharmacy. Upperbound is not a medical group, does not practice medicine, and does not guarantee that any treatment will be prescribed. All clinical decisions are made solely by the treating physician.
You must be at least 18 years old, reside in a state where our physician network operates, and provide accurate, complete information in your intake. Providing false health information can create real danger for you and is grounds for immediate termination of service.
You pay before your medical intake is reviewed. If the physician does not approve a pathway for you, your payment is refunded in full. Beyond that guarantee, payments for care already delivered are not refundable except where required by law.
Upperbound is not an emergency service. If you are experiencing a medical emergency, call 911.
You agree not to misuse the platform, share your account, attempt to obtain treatment for another person, or resell or transfer anything prescribed to you. Prescriptions are personal and non-transferable.
Individual experiences vary and nothing on our marketing surfaces is a promise of a specific result. To the maximum extent permitted by law, Upperbound's liability to you is limited to the amounts you paid us in the twelve months before the claim arose. Nothing in these terms limits the physician's independent professional responsibility to you.
These terms are governed by the laws of the State of Texas. Disputes will be resolved in the state or federal courts of Texas unless applicable law requires otherwise.
We may update these terms and will post the current version here with its date. Continued use after a change means you accept it.
